By accessing or using the PULSE Marketing Intelligence Platform ("Platform") operated by Pulse Intelligence LLC ("PULSE", "we", "us"), you ("User", "you") agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not access or use the Platform.
These Terms apply to all users of the Platform, including subscribers, authorized team members, and visitors to our website.
PULSE is a cloud-based marketing intelligence platform that provides:
The Platform is designed for business use and is not intended for personal or consumer use.
You must be at least 18 years old and authorized to act on behalf of the organization subscribing to the Platform.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account.
Subscribers may grant access to additional users within their organization as permitted by their subscription plan. The subscribing organization is responsible for the actions of all authorized users.
You may use the Platform solely for your internal business purposes in accordance with your subscription agreement and these Terms.

The Platform, including all software, algorithms, AI models, designs, text, graphics, interfaces, and underlying technology, is the exclusive property of Pulse Intelligence LLC and is protected by copyright, trademark, patent, and other intellectual property laws.
"PULSE", the PULSE logo, and related marks are trademarks of Pulse Intelligence LLC. You may not use these marks without our prior written permission.
You retain ownership of data and content you provide through the Platform ("User Content"). By using the Platform, you grant us a limited license to process, display, and analyze User Content solely for the purpose of providing the Services.
Any suggestions, ideas, or feedback you provide about the Platform may be used by us without obligation or compensation to you.
The Platform uses artificial intelligence to generate insights, recommendations, and reports. AI outputs are provided for informational purposes and should not be considered professional advice. You are responsible for evaluating and acting upon AI-generated recommendations.
While we strive for accuracy, AI-generated content may contain errors or inaccuracies. We do not guarantee the completeness, reliability, or accuracy of AI outputs. Always verify critical business decisions with appropriate professional advisors.
AI features process your data using third-party AI services (currently Anthropic's Claude). Data sent to AI services is processed in accordance with our Privacy Policy and the AI provider's data handling policies.
The Platform may integrate with third-party services (e.g., Google Ads, Google Analytics). Your use of these integrations is subject to the respective third party's terms of service and privacy policy.
Integration with a third-party service does not imply endorsement by PULSE. We are not responsible for the availability, accuracy, or practices of third-party services.
By connecting a third-party service, you represent that you are authorized to grant us access to the relevant data and that such access does not violate any agreement with the third party.
Fees for the Platform are governed by your Master Service Agreement and applicable Statement of Work. By subscribing, you agree to pay all applicable fees as described in those documents. Failure to pay may result in suspension or termination of access.
You may stop using the Platform at any time. Termination of your subscription is governed by your Master Service Agreement.
We may suspend or terminate your access immediately if you violate these Terms, and upon notice if your subscription agreement is terminated.
Upon termination, your right to access the Platform ceases immediately. Sections 5, 6.2, 10, 11, and 13 survive termination.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
To the maximum extent permitted by law, PULSE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform, even if advised of the possibility of such damages.
Our total liability for all claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Pulse Intelligence LLC and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; or (c) your violation of any rights of a third party.
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes shall be resolved through binding arbitration in Jacksonville, Florida, under the rules of the American Arbitration Association. You waive any right to a jury trial.
We may update these Terms from time to time. We will notify subscribers of material changes via email at least 30 days before they take effect. Continued use of the Platform after changes become effective constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Platform.
These Terms, together with our Privacy Policy and your Master Service Agreement, constitute the entire agreement regarding your use of the Platform.
If any provision is found unenforceable, the remaining provisions remain in full effect.
Our failure to enforce any right or provision does not waive that right or provision.
You may not assign your rights under these Terms. We may assign our rights in connection with a merger, acquisition, or sale of assets.
